Result of Service

The following reports and documents should be delivered by the consultant:
1. An assessment of the national legal and institutional frameworks including pos sible gaps to implement the Basel Convention control regime in a report of 10 to 20 pages (Activity 1-1-1);
2. A report of 10 to 20 pages on recommendations and possible adjustments to fill the identified gaps in the legal and institutional frameworks to ensure it fully implements the Basel Convention control regime (Activity 1-1-2);
3. Study of 10 to 20 pages on potential impact of the various proposals to amend the annexes to the Basel Convention with respect to TBM of plastic wastes and develop a report in consultation with stakeholders with recommendations to the attention of the authorities (Activity 1-3-1);
4. Report of 10 to 20 pages on gap analysis of waste management regulations and capacities for their implementation and enforcement; development of draft recommendations for revision of regulations (Norad Activity 3-1-1);
5. Document of 10 to 20 pages on revised recommendations and draft revised regulation in consultation with inter-ministerial coordination committee (Norad Activity 3-1-3).

Duties and Responsibilities

United Nations Environment Assembly at its third session called for increased action by relevant international and regional organizations and conventions, including among others, the Basel and Stockholm Conventions, to prevent and reduce marine litter and microplastics and their harmful effects.

The current consultancy is to support the implementation of the project entitled “Marine litter and microplastics: promoting the environmentally sound management of plastic wastes and achieving the prevention and minimization of the generation of plastic wastes” funded by the Norwegian Agency for Development Cooperation (NORAD)

The Basel Convention covers many of the issues which are at the heart of reducing marine pollution from plastics, i.e. (1) the control of the transboundary movements (TBM) of wastes, (2) environmentally sound management (ESM) of wastes and (3) prevention and minimization of the generation of wastes. The activities of the project are structured within those three thematic areas.

The project targets Bangladesh and Ghana and implemented with support of the Basel Convention Regional Centre for South-East Asia in Indonesia (BCRC-SEA) and the Basel Convention Coordinating Centre for the African Region in Nigeria (BCCC Africa).

Under the supervision of the Secretariat, the consultant will participate in the national consultation meetings organized by the regional centres in the target countries and cooperate with local experts engaged by the regional centres as well as with other implementing partners to undertake the following (with reference to the activity numbers of the NORAD project document):

1. Undertake an assessment of the national legal and institutional frameworks including possible gaps to implement the Basel Convention control regime (Activity 1-1-1);
2. Prepare recommendations and where appropriate, draft adjustments to the relevant laws and regulations to fill the identified gaps in the legal and institutional frameworks to ensure it fully implements the Basel Convention control regime (Activity 1-1-2);
3. Analyze potential impact of the various proposals to amend the annexes to the Basel Convention with respect to TBM of plastic wastes and develop a report in consultation with stakeholders with recommendations to the attention of the authorities (Activity 1-3-1);
4. Gap analysis of waste management regulations and capacities for their implementation and enforcement; development of draft recommendations for revision of regulations (Activity 3-1-1);
5. Revise recommendations and draft revised regulation in consultation with inter-ministerial coordination committee (Activity 3-1-3).

Qualifications/special skills

Academic Qualifications: An advanced university degree in law, environment, or related discipline, or a first university degree in combination with two additional years of qualifying experience may be accepted in lieu of the advanced university degree.
Experience: At least seven years of experience in the field of the implementation of the Basel Convention, environmental management, legal and institutional frameworks for the waste management; development of waste inventory; environmentally sound management of waste; or transboundary movements of waste.
Language: Fluency in English, including strong drafting/writing skills is essential. Knowledge of French would be an asset.
