The end result of the extended research will be to provide an evidence base to design practical strategies and advise on advocacy with the Cuban stakeholders including the Government, and international actors engaged in the sanction regime as well as those who can advocate on the human rights and humanitarian impact of Unilateral Coercive Measures in Cuba.

Duties and Responsibilities

Against the backdrop of a detrimental impact on lives and livelihoods of people created by the COVID-19 pandemic and the longstanding Unilateral Coercive Measures (UCM) imposed on Cuba by the United States, the purpose of this project is to develop a research plan on whether and how sanctions or UCM have affected, directly or indirectly, the enjoyment of the right to health in Cuba. The project will also examine whether sanctions via chain effects could have affected the right to health in other countries with whom Cuba engages.

The project will look at the sanctions imposed to determine if they are sufficiently narrow to avoid impacts on the right to health as well as related economic, social and cultural rights (ESCRs) of Cubans and that of citizens of other countries given Cuba’s history and capacity to manufacture medicines and vaccines and its capacity to train medical practitioners and personnel.

Within delegated authorities, the consultant will undertake preliminary research to design a broader research plan to determine whether and how UCM imposed on Cuba have facilitated or created violations of international human rights and humanitarian law.

In undertaking the research, the consultant will address specific questions such as:
• Are the Sanctions designed to avoid possible impacts on human rights, specifically the right to health and related economic social and cultural rights including the right to food, water and sanitation, etc., and ultimately the right to life?
• Is there any method or procedure that is part of the UCM law that can be invoked if human rights or humanitarian considerations are negatively affected?
• Have there been any studies or hearings on the impact of sanctions on the right to health?
• Have these UCMs impeded the manufacture of medicines and vaccines to such a degree so as to limit the availability of such medicines and vaccines in Cuba and in other countries? If so, what impact has this had especially on the human rights of the marginalized populations?
• What mechanism/s exist within the Sanction’s regime that could have a possible relation to the right to health? For example, export prohibition and money transfer.
• To what degree do sanctions have intended or unintended consequences given the importance of US to international commerce (e.g., a significant amount of software used to medical equipment is manufactured in the US) and US banking to international financial markets (e.g., money transfers often pass through the US)?

The consultant will indicate how much more work is needed on each of these research areas, and how this research could be taken forward in greater detail as well as identify additional research questions.

The consultant will also identify possible researchers to undertake this additional research.

Qualifications/special skills

Academic Qualifications: Advanced degree in law, political science, economics, international relations, social sciences or related field
Experience: A minimum of five years of progressively responsible experience in health and human rights is required. Experience in research and policy analysis on sanctions and universal coercive measures is desirable. Knowledge of country context of Cuba is desirable.
Language: Fluency in English and Spanish is required.
